Refund and Returns Policy

At Fine Art Pics, we want you to be completely satisfied with your purchase. This policy outlines your rights and our procedures for returns and refunds, in compliance with UK consumer law, specifically the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 (for online sales).

1. Your Right to Cancel (for Online Purchases – Distance Selling)

If you have purchased an item online without seeing it in person (distance selling), you have a legal right to cancel your order for any reason within a “cooling-off period.”

  • Cancellation Period: You must inform us of your decision to cancel within 14 calendar days from the day after you receive your goods. If your order consists of multiple goods delivered separately, the 14-day period runs from when you receive the last item.

  • Returning the Goods: Once you have informed us of your cancellation, you have a further 14 calendar days to return the goods to us.

  • Refund: We will issue a full refund, including the standard delivery cost, within 14 calendar days of receiving the goods back or receiving proof that you have sent them back (whichever is earlier). We are not obliged to refund any supplementary costs if you chose a delivery option other than the least expensive standard delivery offered.

  • Condition of Goods: You are responsible for taking reasonable care of the goods while they are in your possession. You may be liable for any diminished value of the goods resulting from the handling of the goods beyond what is necessary to establish their nature, characteristics, and functioning.

  • Return Postage: Unless the item is faulty (see Section 2), you will be responsible for the cost of returning the goods to us. We recommend using a trackable delivery service.

2. Faulty Goods, Not As Described, or Not Fit for Purpose

Under the Consumer Rights Act 2015, all goods must be:

  • Satisfactory quality: They should not be faulty or damaged and should be of at least satisfactory quality.

  • Fit for purpose: They should be suitable for the purpose they were supplied for.

  • As described: They must match the description, model, or sample shown at the time of purchase.

If your item does not meet these criteria, you have legal rights:

  • Within 30 Days: If a fault is discovered within 30 calendar days of purchase/delivery, you have the short-term right to reject the goods and receive a full refund. You must contact us and state that you wish to reject the item.

  • After 30 Days but Within 6 Months: If a fault develops after 30 days but within 6 months of purchase/delivery, you must give us one opportunity to repair or replace the faulty goods. If the repair or replacement is unsuccessful, or if it is not possible or causes you significant inconvenience, you can then claim a refund (in most cases, a full refund) or a price reduction if you wish to keep the product. It is presumed the fault was present at the time you received the goods unless we can prove otherwise.

  • After 6 Months (up to 6 years): If a fault develops after 6 months and up to 6 years (5 years in Scotland) from the date of purchase, you may still be entitled to a repair or replacement. However, after 6 months, the burden of proof shifts to you to prove that the fault was present at the time of purchase.

  • Return Postage for Faulty Items: If an item is faulty, not as described, or not fit for purpose, we will cover the cost of returning the item to us.

3. Proof of Purchase

For all returns, we may ask for proof that you bought the item from us. This could include:

  • Your sales receipt

  • A bank or credit card statement showing the transaction

  • Any other evidence that can prove your purchase from Fine Art Pics

4. Items Not Eligible for Return (Exceptions)

Please note that certain items are exempt from the “change of mind” returns under the Consumer Contracts Regulations, or may only be returned if faulty:

  • Personalised items or custom-made items: As our products are fine art prints, if they are produced specifically to your custom order (e.g., a specific print size or framing option that is not standard stock and made solely for your order), these may be exempt from the 14-day cooling-off period unless they are faulty. This will be made clear at the point of sale.

  • Unwrapped items where hygiene is a factor: (Not typically applicable to our products but mentioned for completeness of a general policy).

  • Digital Content (e.g., downloadable images): You will lose your 14-day right to cancel digital content if you have expressly agreed for the download to begin within the cancellation period and have acknowledged that you lose your right to cancel. If digital content is faulty, you are entitled to a repair or replacement. If that is not possible, you may be entitled to a price reduction or refund.

5. How to Initiate a Return or Refund

To request a return or refund, please follow these steps:

  1. Contact Us: Email us at stephen@fineartpics.co.uk or call us on 07701 027452 as soon as possible, providing your order number and the reason for the return.

  2. Await Instructions: We will provide you with instructions on how to return your item.

  3. Package the Item: Please package the item securely to prevent damage during transit. If the item is not faulty, it should be returned in its original condition and packaging where possible.

  4. Send the Item: Return the item to the address provided: 41 Bishopswood Rd, Tadley, Hampshire, England, RG26 4HF.

6. Refunds Process

  • Refunds will be processed to the original payment method used for the purchase.

  • As per legal requirements, refunds for cancelled distance sales will be processed within 14 days of receiving the returned goods or proof of return. Refunds for faulty goods will also be processed promptly.

  • We will notify you once your refund has been processed.
